01 DESCRIPTION OF SERVICES

Your Money Is Waiting helps homeowners and their heirs recover surplus funds left over after foreclosure and tax sale auctions in Florida. Our work includes records research, owner verification, document preparation, claim filing, and follow-through with the relevant county or court.

We are not a law firm and do not provide legal advice. Where a matter requires attorney involvement, we engage licensed attorneys barred in the applicable jurisdiction to handle the legal portions of the work.

02 FEES AND PAYMENT

We work on a contingency basis. You pay nothing upfront. Our fee is a fixed percentage of the surplus funds we recover for you, agreed to in writing before any work begins.

If we do not recover funds, you do not owe us a fee. Fees are deducted from the recovered amount when the county or court releases the funds. The balance is paid directly to you.

03 CLIENT RESPONSIBILITIES

We do most of the work, but a few things have to come from you:

• Provide accurate information about the property and sale

• Send identifying documents we need to file the claim

• Respond to our requests in a reasonable timeframe so deadlines are not missed

• Tell us if your contact details change

• Disclose if anyone else has filed or is trying to file a claim on the same funds

04 SMS TERMS & CONDITIONS

SMS consent is optional and is never required to use our website or services.

We operate two separate SMS consent programs, each requiring its own checkbox on our contact form.

Non-Marketing Messages

By checking the non-marketing SMS consent box, you opt in to receive case-related text messages from Your Money Is Waiting, including case status updates, document notifications, appointment reminders, and account alerts.

Marketing Messages

By separately checking the marketing SMS consent box, you opt in to receive occasional promotional and marketing text messages from Your Money Is Waiting.

Checking one box does not enroll you in the other. Submitting the form without checking either box does not enroll you in SMS messages of any kind. We record your consent along with your phone number and the date and time.

Message Types

Non-marketing messages include case status updates, document notifications, appointment reminders, and account alerts.

Marketing messages include occasional promotional offers and service announcements.

Message Frequency and Rates

Message frequency varies. Non-marketing message frequency depends on the stage of your claim. Message and data rates may apply depending on your wireless carrier and plan.

Opt-Out

Reply STOP to any message to opt out. You can also contact us to remove your number. After opting out you will receive one final confirmation message and no further messages will be sent unless you re-opt in.

Carriers are not liable for delayed or undelivered messages.

No Mobile Information Sharing

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. This includes mobile phone numbers and SMS opt-in or consent data, which will not be shared with any third parties.

05 NO GUARANTEE OF RECOVERY

We do not promise a specific outcome. Surplus funds cases depend on county records, court rulings, claim windows, and the rights of competing claimants. We cannot guarantee that funds exist for any specific property or that a filed claim will be approved.

Nothing on our website or in our communications is legal advice. If you need legal counsel for a specific matter, hire a licensed attorney in your state.

06 LIMITATION OF LIABILITY

To the fullest extent permitted by law, our total liability for any claim arising from your use of our website or services is limited to the fees you have paid us in connection with the matter at issue.

We are not liable for indirect, incidental, or consequential damages, lost profits, or lost data.

07 GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the State of Florida, without reference to conflict-of-laws rules.

Any dispute that cannot be resolved by mutual agreement will be brought in the state or federal courts of Florida, and you agree to that venue.

If any part of these Terms is found unenforceable, the rest remain in effect.

08 CHANGES TO THESE TERMS

We may update these Terms and Conditions from time to time. Any changes will be posted on this page with an updated effective date.

Continued use of our services after changes are posted constitutes acceptance of the revised terms.
